Terms of Service

Effective September 16, 2026

The short version: you must be 18+. Apex is general fitness and nutrition information, not medical advice. Check with your doctor first and check your own food allergies. Results aren't guaranteed. All sales are final. Your program is for you only: sharing it ends your access. Apex Pro renews until you cancel.

Who we are and what these terms cover

Apex is run by Noah Rychlick, doing business as Apex Fitness Academy (“Apex,” “we,” “us”), based in Florida. These terms apply to apexfitnessacademy.com, the Apex Program, Apex Pro, and everything inside your Apex account.

By buying a program, creating an account, or using the site, you agree to these terms. If you don't agree, don't use Apex.

You must be 18 or older

Apex is for adults only. You must be at least 18 to use the site, answer the intake questions, or buy anything.

What you're buying

  • Apex Program ($147, one payment). A 12-week program assembled from your intake answers: training plan, meal plan, guides, and tracking tools. You get lifetime access to the version you bought. It doesn't include future versions, new training cycles, or automatic adjustments.
  • Apex Pro ($49 a month or $399 a year). An optional subscription that adds automatic calorie adjustments, meal plan switching, new 12-week training cycles, and content updates. It renews automatically at the end of each billing period until you cancel. Cancel anytime from your billing settings: cancellation stops future charges, and you keep Pro until the end of the period you've paid for.
  • Apex 1:1. Personal coaching is sold separately on a call and isn't purchased through these checkout pages.

General information, not medical advice

Apex provides general fitness and nutrition information for healthy adults. It is not medical advice, diagnosis, or treatment, and it doesn't replace a doctor, registered dietitian, or other licensed professional. Calorie and protein numbers are starting estimates calculated from what you tell us.

You're responsible for talking to a physician before starting any exercise or nutrition program, and for answering the health check honestly. If you tell us a doctor has cleared you, you're confirming that's true. Read the Medical & Fitness Disclaimer.

Food allergies and intolerances

Meal plans are built from common foods and can't account for allergies, intolerances, or medical diets. You're responsible for checking every ingredient and swapping anything you can't safely eat.

Results aren't guaranteed

Results depend on you: your body, your consistency, your sleep, your stress, and many things we don't control. We don't promise any specific result. Client results shown on the site come from Apex 1:1 coaching clients, not from the self-guided program, and they aren't typical or guaranteed.

Payments and refunds

Prices are in US dollars. Applicable taxes are calculated at checkout. Payments are processed by Stripe; we never see or store your full card number.

All sales are final. See the Refund Policy. If you were charged twice or billed in error, email inclineinvest10k@gmail.com and we'll fix it.

Your license to use Apex

When you buy, you get a personal, non-transferable, non-exclusive license to use your program for yourself. All program content, including training plans, meal plans, guides, and PDFs, belongs to Apex.

You may not share your account, resell or redistribute the content, post it publicly, or use it to coach other people. If you do, we can end your access without a refund.

Your account

You log in with links sent to your email, so keep your email account secure. Give us accurate information, and tell us if you think someone else has accessed your account.

Assumption of risk

Exercise, including strength training, jumping, sprinting, and conditioning, carries a risk of injury, and changing how you eat can affect your health. You choose to do this voluntarily and accept those risks. Use proper form, use equipment safely, and stop any activity that causes pain, dizziness, or shortness of breath.

No warranties

Apex is provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose and uninterrupted or error-free service.

Limitation of liability

To the fullest extent the law allows, Apex and Noah Rychlick aren't liable for any indirect, incidental, special, or consequential damages, or for any injury, illness, or loss arising from your use of Apex.

Our total liability for any claim relating to Apex is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not all apply to you.

Ending your access

You can stop using Apex anytime. We can suspend or end access if you break these terms, including sharing your account or redistributing content, or if a payment is reversed or disputed.

Governing law

These terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute will be handled in the state or federal courts located in Florida.

Changes to these terms

We may update these terms. If a change is significant, we'll email you before it takes effect. Continuing to use Apex after that means you accept the updated terms.
